"Joseph is an example of a patient for whom marijuana has had a life-changing positive effect," the complaint states.
A Walmart spokesman said he sympathized with Casias, but defended the dismissal.
"Like other companies, we have to consider the overall safety of our customers and our associates, including Mr. Casias, when making a difficult decision like this," said Greg Rossiter.
The American Civil Liberties Union also has filed a lawsuit against the nation's largest retailer.

Doubt it. Those are legal dontcha know. Like that makes any sense....*pic in my mind of choice between a drooling oxy'd out cashier or a gonja smoking cashier..uh, no contest..pass it over to me, my friend. Good article and, as always, Wal-Mart has their heads up their azzes in an illogical sense. LoL

I don't understand how they can do that since it is legal use of marijuana, especially since he could have been doped up on valium or oxycontin and he would have kept his job. I do think thepossibility of getting out of a compensation claim is a possible reason, though I have seen time and time again workers on drugs such as vicodin, benzos, etc have no problems. It is unfortunate, the stigma of weed. I hope the guy prevails in his case.

Javabean88; Me too!! It's a real shame that pot is so stigmatized. As a retired nurse investigator I have seen what this wonderful weed can do for those with everything from chronic pain, cancer, aids, diabetes side effects, even blood pressure! It's a medicinal plant and,yes, it's a drug but so much safer than most on the market. oh, it's fantastic for people with glaucoma also.

The stigma that attends marijuana use, though waning is still strong, however it wasn't the man's marijuana use that made Walmart fire him, it was his injury. They are not interested in anyone's safety they are interested in making money. If they can get out of a compensation claim by firing this unfortunate fellow you can bet they will fire him. It will be interesting to see if the ACLU makes any headway with this case. I would bet on Walmart over justice in this one.

Dark - I can only go on the article that said he was fired after testing positive for marijuana which was after getting injured. Oh! Or, I see...you're saying that had he not injured himself, there'd have been no need for a drug test and therefore would still have his job? In other words, the fact he injured himself AT work while ON a mind-altering substance is the issue. [Irrespective of whether it was pot (or vicodin, percocet, etc...).]
Ahhhh... Yes, that's a little different than just smoking up the ganja.

this fact is suspect for the very reason that he may not have been actually ON said substance because the the metabolic by-products of THC remain in the body long after one ceases to be intoxicated. Tested and proven fact: a person w/ no detectable drugs in his/her system can ingest an intoxicating dose of THC and not test "hot" for periods from 6 to 12 hours. This idea of a "hot" sample being indicative of current intoxication is bunk, pure and simple.

I'm a member of the ACLU for the reason my civil liberties have been stomped on so many times over the years I said, "Enough!" They fight my civil battles for me now and do a very nice job of scrubbing the floor with mental infidels such as Wal-Mart.

He's saying once the dude tested positive Walmart could fire him and not pay for his on-the-job knee injury, even if he wasn't on pot at the time of the injury. If he had smoked the night before, or the week before, he would have still gotten fired. [But if he took valium the night before to get to sleep he wouldn't -- you have to use corporate profit-generating drugs only in a corporatocracy.)
